Please read these General Terms of Use (hereinafter referred to as 'GTU') carefully before using the OCTO+ mobile application (hereinafter referred to as 'the Application'). By using this application, you agree to be bound by these GTU. If you do not accept these GTU, please do not use the Application.
1.1 The OCTO+ Application is a gateway allowing users to access content provided by third parties via external links.
1.2 By using the Application, you acknowledge and agree that:
1.2.1 The Application does not provide any content directly, but acts only as a means to access third-party content.
1.2.2 You are solely responsible for your use of the Application and access to third-party content through it.
1.2.3 You must not use the Application in a way that violates applicable laws or regulations.
2.1 All intellectual property rights related to the Application, including, but not limited to, copyrights, trademarks, and property rights, are owned by OCTO+ or its licensors.
2.2 You agree not to reproduce, distribute, modify, publicly display, perform publicly, or create derivative works from any content available through the Application without the express written permission of OCTO+ or its licensors.
3.1 The Application is provided 'as is' without any warranty, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
3.2 In no event shall OCTO+ be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of the use or inability to use the Application or the third-party content accessed through it.
4.1 OCTO+ reserves the right to modify these GTU at any time. Any modifications will take effect immediately upon their publication on the Application. It is your responsibility to regularly review the GTU to ensure you are aware of any changes.
5.1 These GTU are governed and interpreted in accordance with the laws in force in your country. Any dispute arising from these GTU will be subject to the exclusive jurisdiction of the courts of the country.
6.1 You agree not to use the Application in a way that:
6.1.1 Violates any applicable law or regulation.
6.1.2 Infringes on the intellectual property rights of others.
6.1.3 Publishes or shares any illegal, offensive, defamatory, obscene, or inappropriate content.
6.2 OCTO+ reserves the right, at its sole discretion, to terminate or suspend your access to the Application in case of a violation of these GTU or any applicable law or regulation.
7.1 Users are also subject to our Privacy Charter, which governs the collection, use, and protection of users' personal information.
8.1 OCTO+ reserves the right to terminate or suspend your access to the Application at any time and for any reason, without notice or liability to you.
9.1 These GTU constitute the entire agreement between you and OCTO+ regarding the use of the Application, and supersede all previous or contemporaneous agreements between you and OCTO+.
9.2 If any provision of these GTU is found to be invalid or unenforceable by a competent court, the parties agree that the other provisions of these GTU shall remain in full force and effect.
9.3 Failure to exercise or enforce any right or provision of these GTU shall not constitute a waiver of such right or provision.
